Your dream car just got that much better! By becoming a sponsor of a 2011 Lexus IS 250 Convertible, you will be help benefit the charitable efforts of the BB&T Charleston Wine + Food Festival, a 501(c)(3) non-profit. One Sponsor will be awarded the Lexus during the 2011 Festival (date and time of announcement TBD) Sponsorships are $100.00 each and only 1000 sponsorships are available.

For federal tax purposes, your contribution is deductible to the extent allowed by law.

Official Rules and Terms

Eligibility: You must be 18 or older to become a “Sponsor”. You must submit a short essay (one sentence or more) of why you want to support the Festival’s charity efforts. Only one (1) individual may be identified as the donor for each sponsorship. All federal, state and local laws apply. You may donate safely and easily by charge or debit card on the secure website. When your sponsorship donation is confirmed, you will receive a confirmation in via email. All communications, including sponsorship confirmation, will be sent to the email address you supply during the donation transaction process. It is your responsibility to provide valid postal and email addresses in order to receive confirmation of your sponsorship and to receive notification if you are selected. Please remove any spam or system blocks that would prevent the successful delivery of an email confirmation. The Festival, Lexus of Charleston, Related Entities and its employees, agents, vendors, board, officers, sponsors, charities, donors, volunteers and members assume no liability for lost of undeliverable sponsorship notifications or for the sponsorship notifications deemed invalid as spam.

Selection: The selection of the (1) “Sponsor” will be conducted as follows: one (1) Sponsor and their essay will be selected during the Festival (Final date and time TBD) to receive the Lexus (“Item”). The sponsor confirmation is required to claim the item (lost sponsor confirmations are available to reprint with proper identification).

Sponsorship Item: The Item will be awarded on the selection date (TBD). The Item may not be exactly as shown, but will have a value equal to the item documented on the website and in marketing materials. The approximate total value of the Item is $48,748, based on the price at the time of the Item selection. All sponsorships are eligible to win the Item. If a winning sponsorship is claimed by more than one individual, the Festival will award the Item to the name listed with that confirmation in the database. The Festival is not responsible for resolving the disputes or confliction claims of sponsorship ownership.

Notification of selected Sponsor: The selected Sponsor will be notified in writing by the Festival within fourteen (14) days of the selection. The Sponsor will have fourteen (14) calendar days from notification of being selected to inform the Festival of their time to get the Item. The selected Sponsor is requires to take delivery of the Item within forty-five (45) days after the selection date. The selected Sponsor’s name and location will be posted on the Festival’s official website www.charlestonwineandfood.com. If the Festival is unable to contact or locate the selected Sponsor after a period of sixty (60) days from the selection date, a second selection for the Item will be made. If after the second selection, a Sponsor cannot be contacted after a period of sixty (60) days, the Festival will decide what to do with the Item. Reasonable attempts to contact the Sponsor shall be made to both the email and postal mail addresses of record in our database, and to the phone number provided by the sponsor.

Lexus Rules: One (1) 2011 Lexus IS 250 C will be provided to one (1) Sponsor. The selected Sponsor will be fully responsible for all applicable taxes, fees, assessments, tags, titles, insurances, registrations, transports, and delivery of vehicle. The selected Sponsor will be required to provide proof of insurance prior to taking possession of a vehicle. The selected Sponsor has opportunity to upgrade vehicle package and select color of vehicle at sole cost of selected Sponsor and subject to availability. Value of vehicle is not redeemable for cash or applied to another make of vehicle. Value of vehicle may be applied to another Lexus model. The item is non-transferable. The selected sponsor must accept delivery of item at Lexus of Charleston (at 2424 Savannah Highway, Charleston, SC 29414-5322) and is responsible for all costs associated with the transport of the vehicle.

GENERAL CONDITIONS AND INDEMNITY AND RELEASE: The sponsorship is subject to all applicable federal, state and local laws. By becoming a sponsor, each and every sponsor and the selected Sponsor: (1) agrees to indemnify, release and hold harmless the Festival and the Related Parties from any and all losses, damages, rights, claims and actions of any kind in connection with the sponsorship; (2) agrees to be fully and completely bound by these Official Rules; (3) agrees to indemnify, release and hold harmless Festival and the Related Entities from any and all liability for any loss, harm, damages, costs or expenses, including without limitation property damages, personal injury and/or death arising out of participating in this sponsorship, or the delivery, acceptance, possession, use or misuse of any item and claims based on publicity rights, defamation or invasion of privacy, copyright infringement, trademark infringement and/or any other intellectual property right; and, (4) the selected Sponsor consents to the use of his/her name, submitted entry (including but not limited to statements and/or jingles), photograph, likeness, statements, testimonials, and/or text for advertising, promotional or any other purposes in any medium throughout the world in perpetuity without additional compensation or consent unless prohibited by law. Eligibility, age and claims made by the selected Sponsor are all subject to verification. The Festival and Related Entities are not responsible for fraudulent calls or e-mails sent to sponsors not authorized by the Festival.

The Festival reserves the right at its sole discretion to disqualify any individual who: (1) tampers or attempts to tamper with the sponsorship process or the operation of the sponsorship; (2) violates these Official Rules; (3) acts in either an unsportsmanlike or disruptive manner; or, (4) acts with the intent to annoy, abuse, threaten or harass any other person. Each sponsor and the selected Sponsor acknowledges that the Festival and the Related Entities have neither made nor are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the item.
